1. Effect of this agreement

Viewing of the Canvas Art Direct UK site itself is free; but when you purchase from the site, you agree to the terms of this agreement, and you re-affirm that agreement every time you use the Canvas Art Direct UK services, so we recommend you read this agreement so you know what you're getting yourself into. In order to make a purchase or purchases from Canvas Art Direct UK you will need to register an account with us. Registration takes less than 30 seconds and is absolutely FREE of charge. Your account details will not in any way be passed onto any third party or submitted on any email marketing lists.

2. Applicable law

Www.canvas-art-direct.co.uk, www.funkycanvasart.com and www.funky-canvas-prints.com are websites owned by Canvas Art Direct UK registered in England & Wales. Every sale shall be deemed to be performed in England. English law shall govern each transaction, including (without limitation) all contractual and other relationships, which arise as a result of such sales. You and we submit to the non-exclusive jurisdiction of the English courts in relation to any disputes arising out of any sale.

3. Engaging In a Contract with Canvas Art Direct UK

When making a transaction with Canvas Art Direct UK, we ask that you agree to register for a Canvas Art Direct UK user account using your correct name, address and any other requested details. You may be asked to enter credit, debit or charge card details. You must ensure that (a) you are fully entitled to use that card at the time when you provide those details to Canvas Art Direct UK, and when you use the card it has available funds to cover all charges incurred on it in the course of buying from us. If any of the information you enter becomes incorrect or is superseded, then please notify us with the corrected information immediately. If you prefer to call us and make a payment over the phone, we also cater for this facility. Canvas Art Direct UK does not store any card details on file neither are we able to view your card details as once a payment has been processed all details are removed from our merchant bank account.

4 Tax & Duties

For purchases made to be delivered outside the European Union, you will automatically be responsible for paying all applicable duties if any apply. Canvas Art Direct UK will not be held responsible for any customs duties which may be incurred when shipping outside of the UK.

5. Images / Frames / Corrections

Descriptions of goods and services offered by Canvas Art Direct UK are accurate to the best of our knowledge. We do our best to correct errors or omissions as soon as we are aware of them. However, you should know that the colours and appearance of images, mounts and frames may vary very slightly from the way they appear on the screen. Also print sizes can vary slightly with each production run. If you need to know the precise dimensions of a product, please contact us. If you require artwork in a customised size please contact the Canvas Art Direct UK team and we will do our best to create it for you. All customisation are subject to reasonable requests.

6. Copyright

You accept that the images and designs used on the Canvas Art Direct UK website are the property of Canvas Art Direct UK or their respective copyright owners, and are used by Canvas Art Direct UK pursuant to express authorisation from copyright owners or their agents. You acknowledge that all copyright, trademarks and other intellectual property rights in and relating to Canvas Art Direct UK or our partners where appropriate. You must not use, reproduce, modify or distribute our images or any part of those images in any manner, whatsoever. In the event that there is any dispute between us in relation to this issue, you agree that until the matter is resolved, an interim injunction will be an appropriate remedy. An Interim injunction is a court order, which would prevent any further use or distribution of the image that we are concerned about, until a final court hearing where the court will make a decision on all the facts.

7. Loss

Please be aware that we will not be liable to you or any third party for any indirect or loss or damage, or for any loss of data, profit, revenue, business or management time, howsoever caused.
You also agree that the liability of Canvas Art Direct UK under this agreement (whether arising in negligence or otherwise), will not under any circumstances exceed the greater of a) £500 or b) an amount equal to the sums paid or payable by you. This does not affect your statutory rights as a consumer.

8. Fraudulent Claims

All customers are warned not to make Fraudulent claims against Canvas Art Direct UK. We invest a lot of time and money into ensuring all customers receive their goods in A1 condition. All art work will be sent via our network of couriers. Please note all parcel will need to be signed for upon delivery. We advice all customers to check parcels on delivery for any damage to the box or content. If you are unable to check your box, please clearly state on the driver’s document and sign as UNCHECKED. All parcels will be provided with a tracker number which will allow buyer to track their artwork at every stage of the delivery process. Real time signature will also be available within minutes of customers signing for goods. Real time signatures can be checked online via Canvas Art Direct UK, to confirm receipt of goods.

8.1 In the event of consequential loss, Canvas Art Direct UK can only be responsible for the cost of your order.

9. Negligence

We thought we should state that nothing in this agreement limits Canvas Art Direct UK liability for personal injury or death resulting from our negligence.

10. Reasonable Control

Canvas Art Direct UKshall not be liable for any failure to perform its obligations under this agreement if caused by matters beyond our reasonable control. Without limiting ourselves here in any way.

11. Changes to this Agreement

Canvas Art Direct UK reserves the right to change the terms of this agreement from time to time, and post a new version on our website. The new version will take effect from the day of posting on the site. Price and availability information are also subject to change without prior notice.

12. Severability

In the event that any term of this agreement is held to be unenforceable or invalid by judicial decree or decision, the remainder of this agreement shall remain valid and enforceable.

13. Terms and Conditions - Security and Privacy

We know you're concerned about security and privacy. We want to reassure you that any information you give us during the registration or ordering process as well as any that we know about you by other means will be well protected. We also feel it is important that you know exactly how any information you give us is used and that all information is collected lawfully and in accordance with the Data Protection Act 1998.

13.1 The privacy policy forms part of the agreement between us, and by purchasing goods from our site, you agree to be bound by the terms and conditions of the agreement between us. You also give your consent to the way we may handle your personal data in the way stated in this policy statement. Canvas Art Direct UK will not use this data, or disclose it to any other party, either during registration or at any other time, without your express permission, given during registration or at some other time.

14. How we protect your data

Any credit card information you give us will be held at a secure and separate site, and once we have authorised your purchase, we will delete part of the number and details, so that even in the highly unlikely event that our site security was breached for any reason your credit card details would be unusable.

17. Refund & Cancellation Policy

17.1 Here at Canvas Art Direct UK we want all our customers to be happy with the purchase they are making, that is why we offer a 14 day money back guarantee, excluding the cost of postage. If you are not totally satisfied with your purchase you may return it to us within 14 days of receipt in its original package. All returned goods will inspected by our returns department and refunds issued within 3-5 days from receipt of goods.

18. Shipping Policy

18.1 All artwork will be securely wrapped in our custom built art boxes. Unless otherwise specified all artwork is sent either via, Interlink Express, DHL, FedEX or Royal mail on a next day delivery. 18.2 If you are ordering outside the UK, Canvas Art Direct UK will not be held responsible for any Import or Customs Taxes you may incur.
